Terms and Conditions for Diving Equipment Rental - Egypt
These Terms and Conditions govern the rental of diving equipment provided by our company in Egypt. By renting our equipment, you agree to comply with these terms and conditions. Please read them carefully before proceeding with the rental.
1. General Terms
1.1. These Terms and Conditions apply to all equipment rental services provided by our company for diving activities in Egypt.
1.2. The company reserves the right to amend or update these Terms and Conditions at any time. Any changes will be communicated to the customer in advance.
1.3. By renting equipment from us, you confirm that you are a certified diver or that you have the necessary experience and knowledge to safely use the rented diving equipment.
2. Rental Agreement
2.1. The rental agreement comes into effect when the customer completes the reservation process and receives confirmation of the booking.
2.2. The customer must provide a valid diving certification and identification at the time of booking and upon equipment pickup.
2.3. The customer agrees to use the rented equipment solely for recreational diving purposes. Any commercial or illegal use of the equipment is strictly prohibited.
2.4. The customer agrees to follow all safety guidelines provided by the company and applicable local regulations during the use of the equipment.
3. Equipment Rental Period
3.1. The standard rental period for diving equipment is one day, with additional days available upon request.
3.2. Rental periods are calculated on a 24-hour basis. Late returns may incur additional charges at the daily rental rate.
3.3. If the rented equipment is returned damaged or after the agreed-upon return time, the customer will be liable for repair or replacement costs.
4. Equipment Availability
4.1. The company will make reasonable efforts to ensure that the requested equipment is available at the time of the booking. However, the company does not guarantee the availability of specific items and may substitute equipment of equal quality if necessary.
4.2. In the event of equipment failure during use, the company will offer a replacement or refund for the affected equipment.
5. Rental Charges and Payment
5.1. The rental charges are determined based on the type and quantity of equipment rented, as well as the rental period.
5.2. Payment for the rental must be made in full at the time of booking or upon pickup of the equipment, depending on the terms agreed.
5.3. Accepted payment methods include credit cards, debit cards, and cash.
5.4. If any damage or loss occurs during the rental period, the customer will be charged for the repair or replacement costs, as well as any applicable administrative fees.
6. Liability and Safety
6.1. The company provides high-quality and well-maintained equipment, but the customer is responsible for inspecting the equipment before use to ensure its safety.
6.2. The company is not liable for any accidents, injuries, or damages that occur as a result of the customer’s misuse of the rented equipment.
6.3. The customer is responsible for following all safety instructions provided by the company, including but not limited to diving practices, equipment handling, and emergency procedures.
6.4. The company strongly advises divers to always dive with a buddy and to avoid engaging in diving activities if feeling unwell or unfit for diving.
7. Cancellation and Changes
7.1. Cancellations of rental bookings must be made at least 48 hours before the scheduled pickup date for a full refund.
7.2. If a booking is canceled less than 48 hours before the pickup date, a cancellation fee equal to 50% of the rental cost will apply.
7.3. Any changes to the booking, such as changing the rental period or equipment type, must be made in writing and are subject to availability.
8. Damages and Losses
8.1. The customer is responsible for the equipment from the time of pickup until its return.
8.2. If the equipment is returned damaged, the customer will be charged for the repair or replacement costs.
8.3. In the case of lost equipment, the customer will be required to pay the full replacement cost, as determined by the company.
8.4. The customer agrees to return the equipment in the same condition as it was received, aside from normal wear and tear.
9. Insurance
9.1. The company does not provide personal insurance for divers.
9.2. The customer is strongly advised to obtain travel and diving insurance before engaging in any diving activities.
9.3. The company is not responsible for any medical costs, lost items, or other incidents that may occur during the rental period.
10. Data Protection
10.1. The company collects personal data, including contact information and diving certification details, for the purpose of processing rental bookings.
10.2. The company will not share personal data with third parties without the customer’s consent, except where required by law.
10.3. The customer has the right to request access to their personal data held by the company, as well as the right to correct any inaccuracies.
11. Governing Law and Dispute Resolution
11.1. These Terms and Conditions are governed by the laws of Egypt.
11.2. Any disputes arising from the rental agreement will be resolved through negotiation and, if necessary, through mediation.
11.3. If a dispute cannot be resolved amicably, the courts of Egypt shall have exclusive jurisdiction.
